REWARD PROGRAM POLICIES
Vanderbilt Beach Motel LLC (“VBM”) is the owner and operator of the Vanderbilt Beach Resort Rewards Program (the "Program"). VBM provides these Rules and Regulations (these “Rules”) for the Program. VBM may amend these Rules at any time.
General Program Information
The effective date of these updated Rules is May 18, 2021. The following sets the rules of the Vanderbilt Beach Resort Rewards Program (the “Program”) and supersedes any previous Rules. Your participation in the Program is governed by these Rules and you should read and understand them.

Program is subject to change - VBM may add, modify or delete any Program term or condition, in its sole discretion, with or without notice, and may terminate the Program at any time without notice.

Member requirements - You must be 18 years or older to be a Program member (a “Member”). Membership is not available to corporations or other entities. You may establish and maintain only one Member Account. [VBM will close out any additional Accounts and will not transfer or reimburse for any rewards or nights in additional Accounts.]

Membership application - To become a Member you must submit a Membership Application. If VBM approves your Member Application, you will be provided a Member Number. When you receive your Member number, VBM will inform you when you are eligible to receive Hotel Benefits and earn VBM rewards. VBM will not apply VBM rewards to your Member Account, nor provide you with Hotel Benefits, before approving your Member Application and activating your Member Number.

Earning VBM Rewards - Reservations must be made directly through VBM in order to earn or redeem VBM rewards. Stays on discounted rates do not earn VBM rewards and VBM rewards may not be redeemed or applied to any discounted rate stay. Some other rates are not eligible for earning and redeeming rewards, including: certain hotel initiated promotions, reward night stays, complimentary rooms, rooms booked through a travel agent or third party online retailer including online travel agencies (unless otherwise expressly noted), stays booked using the employee discount or the friends and family discount. Rooms booked through third party online retailers such as Expedia.com, Orbitz.com, Travelocity.com, Booking.com, Hotels Tonight, Priceline.com, etc., are also not eligible to earn VBM rewards and VBM rewards cannot be applied to such stays.

Program termination - In the event that the VBM Rewards Program is terminated, VBM Rewards Members will have up to twelve (12) months from the date that termination of the VBM Rewards Program is announced (the “Redemption Period”) to redeem active VBM rewards. The Redemption Period does not extend the forfeiture date of any VBM rewards points that are forfeited during the Redemption Period in accordance with the forfeiture policy.

Point Forfeiture Policy

Must remain an active Member - Members must remain active in the Program to retain the points they accumulate. If a Member is not active for 18 consecutive calendar months, that Member forfeits all accumulated VBM rewards. Any “Qualifying Activity” keeps your points active for 18 additional months, beginning with the first month in which the activity is completed through the 18th month of inactivity. A qualifying activity is completed when points post or are removed from your account.

Qualifying Activities - Qualifying Activities include completing a qualified rewards-eligible stay or redeeming VBM rewards.

Non-Qualifying Activities - Not all activities count toward maintaining an active status in the VBM Rewards Program. The following are some examples of non-qualifying activities that do not count toward maintaining an active status in the VBM Rewards Program: completing a non-point-eligible stay (such as a discounted or complimentary stay or other stay that does not qualify to earn VBM rewards) or registering for a promotion.
Program Communications/Reservations

As a Member you may receive email newsletters describing special Program news, promotions and benefits.

Qualifying Activities - As a Member, you may make rewards-eligible reservations by calling the hotel directly or through the hotel’s website www.vanderbiltbeachresort.com.
Earning VBM Rewards

Only the Member can earn - As a Member, you are the only person who may earn points for your account.

What a Stay is - A "stay" is defined as any number of consecutive nights, regardless of check-ins, check-outs or room moves.

Limits on number of rooms/bonus - You may earn rewards for only one room per night. To qualify for rewards, the rooms must be in your name and the reservation must include your Member Number. Additionally, you must stay in the room and the room must be paid in full. If you’re an Orchid Club Member, you only earn Orchid Rewards on one room per stay.

Company billing - If your individual hotel bill is billed directly to a company and you are responsible for authorization of settlement at check-out, your stay is still eligible for VBM rewards, as long as you pay a rewards-eligible rate. However, stays where the hotel bill is part of a group master-billing arrangements where charges for multiple rooms are placed on one hotel bill and billed to a company or common address or settled at check-out by one individual, are not eligible.

Two or more Members in one room - If two or more VBM Rewards members share a room VBM will credit rewards nights to (only) the Member whose name is on the reservation reserving and staying in the room. A guest may not change the VBM rewards number on the stay after the first night has been consumed.

Stay must be completed to earn - To earn rewards on a rewards-eligible stay, you must complete one or more night’s stay in the room that you booked (and pay for all nights stayed). No shows do not earn points on a stay.

VBM Coconut Club Rewards earn rate - All VBM Rewards Members begin as Coconut Members. Except as noted below, Coconut Club Members earn 10% off one future stay after staying with us for 10 nights. They earn another coupon for 10% after they stay another 10 nights.

Florida Residents Additional Earnings - Coconut Club Members who are also Florida residents also receive a $50 credit towards charges for food and beverage at the Turtle Club after staying with us for 5 nights. The $50 credit can be only be redeemed to offset food and beverage charges from the Turtle Club that are charged to their hotel bill. The credit can be redeemed at checkout (again only if the guest has charged TC food and beverage to their account) and it must be used in its entirety when redeemed - no “change” will be provided and no cash will be provided.

Rewards posting time - While rewards may be posted quickly, allow up to 20 days after checking out for rewards to post to your account.
Orchid Club Membership
Orchid Club Membership of the VBM Rewards Program provides additional benefits over standard Coconut Club Membership. Membership levels are subject to change at any time, with or without notice, as are the benefits associated with them.

Earning Orchid Club status - Orchid status is based upon the number of point-eligible or reward nights stayed per calendar year. Orchid Club Membership is earned after staying 15 rewards-eligible nights per calendar year. You must qualify for Orchid Club level status each calendar year. Qualifying (rewards-eligible) stays completed by Members count toward the number of nights required to reach Orchid status Membership. Non-qualifying stays, however, such as stays booked under certain discounted ate codes, do not count toward the number of nights needed to reach Orchid Club Membership.

Orchid rewards earning bonuses on rewards-eligible stays

Upon becoming an Orchid Member, Orchid Members will receive a credit for $50 that can be applied to the VBR merchandise at the gift shop (which must be charged to their hotel bill).

After staying 15 nights in a year, Orchid Club Members receive the weekday rate for weekend stays. In addition, Orchid Club Members also receive a $100 credit towards charges for food and beverage at the Turtle Club after staying with us for 20 nights. The $100 credit can be only be redeemed to offset food and beverage charges from the Turtle Club that are charged to their hotel bill. The credit can be redeemed at checkout (again only if the guest has charged TC food and beverage to their account) and it must be used in its entirety when redeemed - no “change” will be provided and no cash will be provided.

Orchid Qualifying nights - Coconut Members only earn Orchid Club status (i.e., qualifying nights) on one room per stay.

Room upgrades - Orchid Member room upgrades are determined by each hotel at check-in, are subject to availability and only apply to Member's personal room. Upgraded room types may include recently renovated rooms, rooms on a higher/lower floor, or rooms with favored views. Participation may vary and hotels are not required to upgrade Members' rooms to any specific type.

All Program Rules apply to Orchid Club Membership - Any fraudulent enrollments or abuse of Program benefits may result in the suspension or termination of the Member’s Rewards account, voidance or forfeiture of any awarded points, and/or the rescindment of any rewards night(s).
VBR Rewards Program - General Terms

Rewards are subject to room or specific reward availability and hotel participation.

VBM may periodically modify the Program in its sole discretion, with or without notice, by adding, changing or deleting rewards, points given, reward thresholds, participating hotels or travel partners, and/or changing other Program terms and conditions. If VBM modifies the Program, you may not be able to obtain rewards previously promoted.

VBM Hotels Gift Cards

VBM Gift Cards are subject to terms and conditions.

You may redeem your VBM Gift Card for its face value on hotel stays only and not for cash. There is no expiration date on a VBM Gift Card. The cards will become inactive after one year and can be reactivated by calling the number on the back of the card.

You may not redeem an altered, changed, or expired VBM Gift Card.

VBM will not reissue VBM Hotel Gift Cards, even if lost or stolen.

Gift Card Redemptions

Gift cards are subject to card issuer terms and conditions; consult with the issuer for details.

VBM will mail your gift card by Postal Mail; please allow 2-4 weeks from your request for delivery.

For security purposes, gift cards cannot be shipped to a PO Box or non-U.S. address. Members are required to update the address in their online account, if necessary, before completing a gift card redemption. Any change to your email and/or mailing address will result in your account temporarily locked for security purposes.

VBM will not reissue gift cards, even if lost or stolen. Gift card redemptions cannot be cancelled after they are placed.

Gift card redemptions rules, including the number and dollar value of redemptions and other gift card rules, are subject to change at any time, with or without notice.

Member Record Changes

Name changes - You are responsible for advising VBM of any name change. You must provide VBM with any government/state issued photo ID, such as a driver's license, including your signature, as well as your VBM RewardsMember Number, plus the date of your request, for name change requests. The requirements for a name change are either: (a) an old and new ID respectively showing the old and new names; (b) a marriage or divorce decree showing the old and new name; or (c) an official court document showing the old and new name. A single ID showing only your old or new name does not suffice and will be rejected.

Contact information changes - You are responsible for advising VBM of any changes in your contact information including address, phone number or email address to ensure shipment of your reward to the accurate address.

Other Terms and Conditions

The Program is subject to change - VBM may add, modify or delete any Program Rule in its sole discretion, with or without notice, and may terminate the Program at any time without notice.

There are no rewards transfers - You may not transfer your rewards to anyone or by any means, including through a will or divorce decree.

No combining rewards - You may not combine your rewards with rewards belonging to anyone else, including your spouse.

You can have one Program account only - You may only maintain one Program Account. If you open more than one Program Account and have more than one Member Number, VBM will credit points to only one account and terminate the other.

Termination for fraud or abuse - Any fraudulent enrollment or other fraud, abuse or violations of Program Rules or benefits, or violation of any federal state or local law, may result in the suspension or termination of the Member’s VBM Rewards account, voidance or forfeiture of any awarded points, airline miles, the rescindment of any rewards night(s), and/or any other rewards accrued or issued at any time, at the Member’s loss, and VBM reserves the right to pursue legal action.

Rewards may not be sold - You may not sell or barter rewards or redeem them for cash.

Rewards are not property - VBM rewards in a Member's account do not constitute property of the Member. Rewards are non-transferable and are not redeemable for cash or any other form of credit. Rewards have no value until presented by the Member for redemption in accordance with these Terms and Conditions.

The Rewards amounts shown in your account may be modified - VBM may modify the points listed in your Program account based on actual stay information.

Questions? - If you have questions about a Program stay, points for a stay, or the online statement, you must contact the VBM within 30 days of the online statement date. You must provide VBM with your hotel receipt indicating your paid stay, plus your Member Number, and other appropriate and unaltered documentation. Once received, please allow up to 15 days to process your request.

Online statements - You can review all of your activity on your VBM Rewards Online Statement.

Member responsibilities - You are responsible for understanding the Program rules, tracking your rewards, and maintaining the security of your account. If the security of your account is breached, VBM is not liable for any access that is not authorized or any account activity that occurs, and VBM is not responsible to reimburse Member for any rewards redeemed or other damages. If Member becomes aware of any fraudulent activity, he/she must report it to VBM within 60 days of it occurring and provide any requested information and cooperation for VBM to consider, in its sole discretion, any reinstatement or adjustment.

Lost mail - VBM and its partners are not responsible for delayed, lost or misdirected mail or other correspondence.

Mailing list - If you do not earn points during 3 consecutive months, VBM may remove you from the Program's active mailing list.

You must pay your hotel accounts - VBM may, in its sole discretion, revoke your Membership and points if you do not pay outstanding VBM brand hotel accounts in full when they are due.

The Program and/or point rewarding or redeeming is void where prohibited by law.

Florida law governs this Program - The Program is governed by Florida law, without regard to Florida conflicts of laws principles.

VBM has sole discretion to interpret the Rules - You agree that VBM has the sole discretion to interpret all Program Rules and you hereby agree by your participation in the Program to abide by VBM’s interpretations.

Privacy

The administration of Member's accounts and the provision of offers, rewards, benefits, products and services within the VBM rewards program require the collection, processing and use of data as set out in these Privacy Rules and Regulations. When you become a Member, or have the opportunity to accept expanded offerings after becoming a Member, VBM collects information that you supply, such as your name, address, telephone number, e-mail address, room preference, billing information. By submitting your personal information and agreeing to become a VBM rewards Member, you consent to VBM using personal information about you for the purposes of administering your account(s), and for offering and providing rewards, benefits, products, goods, and services to you in connection with the Program. If you do not consent to your data being used in the manner and for the purposes set out above, you will not be able to participate in the VBM rewards Program or receive information about the rewards, benefits, products, goods, and services we provide in connection with the Program.

To the extent required or permitted by law, VBM may collect, use and disclose your personal information in connection with security related or law enforcement investigations or in the course of cooperating with authorities or complying with legal requirements.

By becoming a VBM Rewards Member, you authorize Choice and its affiliates to contact you via E-mail and postal mail with Program administrative and transactional information.

VBM may occasionally contact you via E-mail (except for European residents who have not consented) and via postal mail about Program promotions, special offers, discounts, airline miles bonuses, or contests. If you would prefer not to receive these communications, you may instruct VBM to remove your name and address as specified below.
